Information for State and Local Agencies
The Administrative Hearings Division of the Iowa Department of Inspections and Appeals conducts administrative proceedings for nearly all state agencies and some local government agencies. While the Division is required to conduct certain contested case proceedings by statute or administrative rule, it is also authorized under section 10A.801(5) of the Iowa Code to conduct any proceeding for any governmental entity on a contract basis. All proceedings are conducted by qualified administrative law judges who are attorneys licensed in the State of Iowa. Division administrative law judges have experience conducting hearings as the sole presiding officer, as a part of a panel of decision makers, or as an advisor and decision drafter for a board or commission.
The Division generally bills for its services conducting administrative proceedings at an hourly rate, based on the time spent by the administrative law judge related to the proceeding. The Division sets the hourly rate each fiscal year to incorporate an appropriate share of the salary expenses of the administrative law judge, clerical support, and other Division expenses. Less than twenty percent of the Division's operating expenses is funded by its General Fund appropriation.
For Fiscal Year 2017, the Division's hourly rate for its services is
$103.75 per hour of administrative law judge time.
Agencies that require in-person hearings outside of Des Moines will also be billed for any travel expenses of the administrative law judge.
The Division sends quarterly bills to state and local governmental agencies. State agencies generally pay with an IET transfer/payment while local agencies must submit a check made payable to the Iowa Department of Inspections and Appeals, Lucas State Office Building, 321 East 12th Street, Des Moines, Iowa 50319.

Unless other arrangements have been made, a case is formally transmitted to the Administrative Hearings Division by submitting a Transmittal Form and other relevant documents to the Division in paper or electronic form.
